The CLARITY Act, the most significant piece of US cryptocurrency market structure legislation to date, has cleared the Senate Banking Committee by a 15-9 vote, with bipartisan support.

The bill is now on the Senate Legislative Calendar, bringing comprehensive crypto regulation closer to reality.

What the CLARITY Act Does

The legislation establishes clear jurisdictional boundaries between the SEC and CFTC:

  • Commodity designation – Most major cryptocurrencies classified as commodities under CFTC oversight
  • Security tests – Clear criteria for when tokens constitute securities
  • Registration pathways – Streamlined processes for exchanges and custodians
  • Consumer protections – Enhanced disclosure requirements
  • DeFi guidance – Framework for decentralised protocols

The Path So Far

The CLARITY Act has moved steadily through Congress:

  • July 2025 – Passed the House of Representatives
  • May 2026 – Cleared Senate Banking Committee (15-9)
  • June 2026 – Placed on Senate Legislative Calendar

Industry Implications

If enacted, the CLARITY Act would:

  • End enforcement-as-regulation – Providing predictable rules rather than case-by-case actions
